WHEREAS, gasoline prices in the state
of Idaho have been impacted by Hurricane Katrina, and as a result gasoline
prices are on the rise; and
WHEREAS, there is a requirement in
Idaho that a gasoline computing device shall be able to display on the face of
the dispenser the unit price at which the device is set to compute; and
WHEREAS, In the face of the
hurricane, and to be consistent with other states dealing with older analog gas
pumps that are unable to display a unit price greater than $2.99 on the face of
the dispenser, Idaho will make an exception to the requirement that: a device
shall be able to display on the face of the dispenser the unit price at which
the device is set to compute;
NOW, THEREFORE, I, DIRK KEMPTHORNE, Governor
of the State of Idaho, by virtue of the authority vested in me by the
Constitution and laws of this state, do hereby order that:
There shall be an exception allowing analog pumps that have the maximum
price capacity of $2.999 to sell by “half-gallon pricing” provided the
criteria established by the Idaho State Department of Agriculture, Bureau of
Weights and Measures for selling by “half-gallon pricing” is met.

WITNESS WHEREOF, I have hereunto set my hand and caused to be affixed the Great
Seal of the State of Idaho at the Capitol in Boise on this 2nd day of September
in the year of our Lord two thousand and five, and of the Independence of the
United States of America the two hundred thirtieth and of the Statehood of Idaho
